Defense lawyers of the Cuba Five jailed in the United States will lead a new legal battle for the reduction of the unjust sentences they now carry out.
In conversation with Cuban journalists, including Prensa Latina, Leonard Weinglass of the US, one of the lawyers of the group, explained the resentencing of three of the sanctioned anti-terrorists will be one of the objectives to achieve.
One decision of the Appeals Court annuled the sentences applied to Antonio Guerrero, Fernando Gonzalez and Ramon Labañino after accepting an error was committed in the sentences appli9ed for the charge of conspiracy to commit espionaje, although it did not include a decision for Gerardo Hernandez and Rene Gonzalez.
Weinglass said the process of resentencing would be carried out under different legal rules to standing ones on occasion of the trial carried out in 2001 and this will allow opportunities to make the life sentences imposed on Antonio and Ramon to be changed for a lesser sanction.
We are relatively sure that, with this reduction of sentences, they will be transferred to a prison with less severe conditions than those they currently have, he added.
The lawyer said, on the other hand, that Gerardo Hernandez should have been included among those sent to resentencing and that is why the lawyers are in disagreement with the ruling of the Appeals Court. But if we manage that in his case be eliminated the charge of conspiracy to commit murder, something that even prosecutors were asking for at the end of the trial in Miami, then it will also be subject to a new decision by the court and we will keep fighting for it, he concluded.
