Atlanta Court Denies Cuban Five Appeal
On September 2, the full panel of the Atlanta Court of Appeals denied the defense’s request for a full-panel hearing to reconsider the Court’s June 4, 2008, decision in the case of the Cuban Five, which upheld the guilty verdicts of the Five, reaffirmed the sentences of Gerardo Hernandez (two life sentences plus 15 years) and René Gonzalez (15 years), and ordered Judge Joan Lenard in Miami to initiate a process leading to new sentences for Ramón Labañino, Antonio Guerrero and Fernando Gonzalez.

On September 2, the full panel of the Atlanta Court of Appeals denied the defense’s request for a full-panel hearing to reconsider the Court’s June 4, 2008, decision in the case of the Cuban Five, which upheld the guilty verdicts of the Five, reaffirmed the sentences of Gerardo Hernandez (two life sentences plus 15 years) and René Gonzalez (15 years), and ordered Judge Joan Lenard in Miami to initiate a process leading to new sentences for Ramón Labañino, Antonio Guerrero and Fernando Gonzalez.
After this decision, the Five's lawyers have until December 1, 2008, to ask the United States Supreme Court to consider an appeal of the case.
Gerardo, Rene, Ramon, Antonio and Fernando – internationally known as the Cuban Five – were arrested in the United States in September 1998 for infiltrating anti-Cuba right-wing organizations in South Florida that were planning and carrying out terrorist actions against the Caribbean nation.
On Thursday the US National Committee to Free the Cuban Five urged all supporters to organize for and support the International Campaign to free the Five.
The solidarity organization announced that on September 12 it will deliver more than 100,000 petitions to the White House demanding the freedom of the Five, and on September 13 there will be a rally and March in Washington, D.C.
After this decision, the Five's lawyers have until December 1, 2008, to ask the United States Supreme Court to consider an appeal of the case.
